Jus Soli in Argentina

Jus Soli (right of the soil) is fully recognized in Argentina, meaning that anyone born in Argentine territory automatically acquires Argentine citizenship, regardless of the nationality or immigration status of their parents.

Citizenship by Birth in Argentina

Under Article 75 of the Argentine Constitution, the following individuals are considered Argentine citizens by birth:

  • ✅ Anyone born in Argentina, including children of undocumented or foreign parents.
  • ✅ Children born in Argentina to foreign diplomats can request citizenship upon reaching adulthood.
  • ✅ Children born abroad to Argentine parents who were in service to the nation (e.g., diplomats, military personnel).

Exceptions

❌ The only exception applies to children of foreign diplomats, but they can opt for Argentine citizenship later.

How to Obtain Proof of Argentine Citizenship

If you are born in Argentina, you need to register your birth and obtain official documents.

  1. Birth Registration at the Civil Registry (RENAPER)
    Parents must register the child’s birth at the local Civil Registry within 40 days.
    Required documents:
    • Hospital-issued birth certificate
    • Parents’ identification documents (passport/ID)
  2. Obtain an Argentine National ID (DNI)
    Once registered, apply for a DNI at RENAPER offices. The DNI serves as proof of Argentine nationality.
  3. Apply for an Argentine Passport (Optional)
    You can apply for an Argentine passport to travel internationally.

Citizenship for Children Born Abroad to Argentine Parents (Jus Sanguinis)

If you were born outside Argentina but have at least one Argentine parent, you can apply for Argentine nationality under Jus Sanguinis.

  • ✔ At least one parent must be an Argentine citizen at the time of birth.
  • ✔ The child must register at an Argentine Consulate abroad.
  • ✔ The child can later obtain an Argentine DNI and passport.

Application Process

  1. Register Birth at the Argentine Consulate
    Parents must report the birth at the nearest Argentine Consulate.
    Required documents:
    • Foreign birth certificate (translated & legalized)
    • Argentine parent’s DNI or passport
  2. Request an Argentine Nationality Certificate
    After registration, apply for a nationality certificate from RENAPER.
  3. Apply for an Argentine DNI and Passport
    Once registered, you can obtain a DNI and passport from the Argentine authorities.

Naturalization – If You Do Not Qualify for Jus Soli or Jus Sanguinis

If you were not born in Argentina and do not have Argentine parents, you can still apply for Argentine citizenship through naturalization if:

  • ✔ You have lived in Argentina for at least 2 years as a legal resident.
  • ✔ You have no criminal record in Argentina or your home country.

Application Steps

  • Submit an application to the Federal Court in Argentina.
  • Provide documents such as proof of residency, employment, and integration.
  • Processing time varies but generally takes 1–2 years.
